When a new market like legal marijuana first hits the scene….

It offers as much risk as it does reward.

Things have started to heat up in the world of cannabis and…

For the first time in our nation’s history, comprehensive legislation to legalize marijuana was introduced in the U.S. Senate.

New York Senator and Majority Leader, Chuck Schumer, formally filed the Cannabis Administration and Opportunity Act (CAOA) on July 21st of this year.

But here’s what most people aren’t seeing…

I believe that the CAOA was never meant to pass.

If you’re unfamiliar with how Congress works, that might seem bizarre…

But as someone who worked as a Capitol Hill press secretary for years…

I’ve was there watching…

Shoulder to shoulder with the powerbrokers…

So I know exactly how they make the “legislative sausage.”

And I think the intent was for the CAOA to be an “icebreaker” bill…

One that’s aggressive. Sweeping. And focused on one main issue.

Which in this case is legalizing weed.

Narrowly focused legislation on controversial issues like this rarely gets passed.

Actually “rarely” is being too generous…

That fact is, it’s far closer to never.

Being the grizzled politicians they are…

Senator Schumer and his co-sponsors, Senators Booker and Wyden, are well aware of this.

But they also know “icebreaker” bills like the CAOA act as the perfect tool for ferreting out opposition… gaining buy-in… and ultimately securing support from both sides of the aisle.

Which is why they designed it as a building block. One that paves the way for a new weed bill both parties can get behind.

Right now, Senators Schumer and Booker are working tirelessly on new bipartisan marijuana reform that many expect to pass THIS year.

And if my sources in Congress are right, which I have no doubt they are…

What’s coming down the pike next is a marijuana “omnibus” legalization bill.

Also referred to as “Big Uglies,” omnibus bills fuse together parts of separate bills to get multiple items passed at once – often before a deadline…

Like this session of Congress which ends shortly.

Because they can roll DOZENS of issues into a single piece of legislation…

Omnibus bills are notoriously effective at passing controversial laws by lumping them in with issues that already have majority support.

For example, in late 2020 while COVID crippled our economy…

President Trump signed the Consolidated Appropriations Act – which combined relief measures like $166 billion in stimulus checks to taxpayers – together with more unpopular measures like $2.3 billion for a U.S. Navy nuclear attack submarine.

And more recently, President Biden signed the Infrastructure Investment and Jobs Act — a $1.2 trillion omnibus bill expected to create thousands of jobs and boost the economy.

The bill authorized a $550 billion investment in roads, bridges, and airports of course…

But strangely enough, it also included some new laws for taxing cryptocurrencies.

So right now you’re probably thinking…

“What does any of this have to do with legalizing pot, John?”

And if you fall into that camp…

You’re asking a good question.

One that has a smack-you-in-the-face obvious answer.

In the last year alone…

Not one – but TWO – major marijuana reform bills have passed in the House of Representatives…

And now await votes from the Senate.

The Marijuana Opportunity Reinvestment and Expungement Act (MORE) moves to end prohibition by descheduling cannabis as a controlled substance…

And the SAFE Banking Act gives legal marijuana businesses access to the same loans, checking accounts, and other financial services that most other businesses enjoy.

SAFE Banking also kicks open the door for big banks to start profiting from the current $33 billion legal pot industry…

Which is just one reason this bill already has more than 40 co-sponsors in the Senate and almost universal support.

Lobbying heavyweight the American Bankers Association – representing the $17 trillion U.S. banking industry – is pushing hard to see the cannabis banking bill become law…

And Wells Fargo, HSBC, Key Bank, M&T Corporation, PayPal, Prudential, and Nationwide are just a few of the huge financial companies licking their chops in anticipation of the financial windfall that could be coming their way.

I share this to make one point, and one point only…

There’s an unprecedented amount of big money, big businesses, and big social interests that support legalizing marijuana.

As I mentioned – I worked in Congress for years, and I had a front row seat to watch dozens of situations like this play out.

Between the legalization efforts that are public knowledge…

PLUS the hushed discussions I’m told are going down behind-closed-doors…

It’s now become crystal clear to me that the Senate could be rolling up a massive omnibus pot bill…

One which includes the widely supported marijuana banking and tax laws that finally allow the government and big banking to sink their teeth into this industry…

The President also tasked the Department of Health and Human Services and the U.S. Attorney General to “expeditiously” review how marijuana is classified under federal law.

He made it clear that even if federal regulators deschedule marijuana…

Certain rules to protect the public should remain in place…

Putting it on par with other mainstream markets like alcohol and tobacco.

Just days ahead of elections, the President’s actions send an important message to Congress about where he stands on weed.

It’s also a telling clue that the highest elected office has recognized the importance of this issue to voters…

Because legalizing marijuana has now become a path to the one thing politicians care about most…

Getting elected.

With Gallup showing a record number of Americans – more than two in three – who support legalization…

$3.7 billion in tax revenue collected in 2021…

And $11.2 billion in total…

Plus, potentially hundreds of billions more in taxes up for grabs with full legalization…

There’s never been such huge incentive for not only Democrats to pull the trigger…

But Republicans as well.

Are you starting to see why I’m so certain we’re at a tipping point?

Look, even if Congress were to stop short of full legalization…

Marijuana banking reform alone could blow the lid off this throttled industry… and send American pot businesses to the moon with profitability.

With midterms just days away… the Democrats are in danger of losing control of the House and Senate…

Which has stepped up their urgency to get this done NOW.

Not only do I expect to see a landmark marijuana omnibus bill introduced in the next few days…

But with the President’s recent actions… on top of overwhelming support for legalization and banking reform…

And just 2 months left to make it law…

I believe by combining the legislation the House has already approved…

This all-or-nothing omnibus bill has what it takes to get a quick “YES” vote in the Senate.

If and when that happens, weed stocks are virtually guaranteed to explode – BEFORE Congress finalizes an omnibus bill.

But when the President does give this bill his John Hancock – as it appears he most certainly will…

I’ve noticed a lot of cannabis start-ups run by young pot enthusiasts with little or no corporate experience…

Which for the most part dooms them to failure.

That’s why I’m intensely focused on finding cannabis companies with A-players on their management roster.

Executives with a track record of building bullet-proof supply and distribution chains…

That ultimately lead to strong revenue…

While maintaining a solid balance sheet that’s not riddled with excessive debt…

Are some of the most critical hurdles a company needs to clear to get my full attention.

Oh My God Why Didn’t We Think of That?!

Companies that offer a product no one else has…

And one that everyone wants…

Typically deliver outsized returns.

When it comes to marijuana…

As legal restrictions fall by the wayside…

And cannabis becomes more common…

Brands – and the ability to set your product apart from the crowd – will become increasingly important.

Cannabis companies that possess this rare skill set – effectively build a moat around their business – which allows them to maintain the ability to grow profits while everyone else’s margins get slashed.

That’s why I look for pot companies with patents, proprietary technology, and one-of-a-kind products...

K-Street (Located in D.C. aka “Lobbyists Row”)

Even full federal legalization won’t end all the regulatory challenges pot businesses face.

That’s why I screen for cannabis companies with strong Washington and state-level lobbying connections that can help protect against government roadblocks…

And help keep their path clear for growth.

No one knows this playbook better than big alcohol and tobacco.

In 2021, alcohol and tobacco companies paid lobbying groups a combined $57 million…

Helping the two industries rake in an estimated $325 billion in sales that same year.

The smartest pot businesses are following suit.

Lobbying is more than just a catalyst for tax relief, banking access, and legalization…

Marijuana companies whose specific interests get the most attention typically enjoy the most growth.

One last note on this…

The best lobbyists are a notoriously finicky lot. And their reputation is everything.

So they’ll only represent companies with squeaky clean financial management controls which includes regular audits by an army of CPAs.

Earnings Growth

“Micro-cap” stocks pop up in the marijuana industry like mushrooms in the rain.

And sure, the pipedream of buying shares at $0.21 and having them shoot up to $5 or $10 is exciting – I mean who wouldn’t love a 4,600% return?

But I’m still not swinging at that pitch.

Behind the scenes these tiny players are mostly unproven… and debt-ridden…

Worse still, their profits fall desperately short of what they promise…

IF they turn a profit at all.

I want businesses that are already making money. LOTS of it.

Because the best indicator of future growth is the current trajectory.

That’s why one of my biggest requirements is that a company’s earnings must be growing year-over-year.

Businesses that make good money…

And then turn around and make more money from that money…

Are the gold standard in any niche.

Because it proves their success isn’t just a pipe dream.

And if a company’s year-over-year earnings are in the negative…

I won’t touch them with a ten-foot pole.

So in summary, first I look for S.M.O.K.E…

And when I find it – then I look for F.I.R.E.

Financial Players

One major tip off a marijuana stock is about to explode higher is the amount of attention it receives from big Wall Street analysts.

I’m not talking about the wannabes spewing their half-baked opinions about weed stocks on social media…

I mean the real number-crunchers at research firms like Morningstar, RBC Capital, and Fidelity.

There are some rocket-science-smart folks working at these outfits…

And they make a lot of money to go through all the details of stocks with a fine-toothed comb.

When a bunch of them get interested in the same company, it’s not by accident...

It means the company is doing something worth noticing.

Sometimes it’s good…

And they all start piling in…

But when the “report card” is bad…

And the company is full of promise – but no profits…

I’ll see institutional investors start shorting the stock…

And that’s a giant flashing red light which tells me to steer clear at all costs.

Insider Confirmation

Here’s a sneaky way to get stock tips that not everyone knows about…

Watch what the “insiders” do.

If a company’s CEO, Chairman, or VPs are loading up on stock…

It’s usually a sign they know something big is about to happen.

And at the very least it means they’re confident in the company’s future.

This is even more true in reverse…

When insiders start dumping their company’s stock, they know something the rest of us don’t.

And it’s not good.

For the company. Or its share price.

My simple rule of thumb: Don’t do anything an insider wouldn’t do.

Right Price

Buying a stock at the right price seems like a no-brainer, right?

Well, amazingly, a lot of investors ignore this rule.

Especially when they’re caught up in the excitement of a red-hot market.

But the bottom line is…

If a stock is far more expensive than its direct competitors…

Or its valuation is greatly out of whack with its earnings growth…

And there’s not some blatantly obvious reason why…

Stay away at all costs!

Before marijuana stocks cooled off in 2019 – they were trading at nosebleed valuations unsupported by projected earnings growth…

Most of those stocks crashed and burned.

The best investors make their money on the buy… not the sale. It’s impossible to do that when you pay too much to get in on the action.

Execution

Famous venture capitalist and billionaire, John Doerr, once said…

“Ideas are easy. Execution is everything.”

And I couldn’t agree more.

That’s why I always use a simple 3-step checklist to make sure every trade I enter on a marijuana stock goes according to plan…

Step 1: Determine the buy-up-to price. This ensures you don’t get caught up in the moment and start chasing a stock as it moves higher. If you didn’t get in on time? Don’t worry. There’ll be more opportunities down the road.

Step 2: Establish whether there are options available – and if you’ll use them. For some folks this a hard “no” every time. And if you fall into that camp, that’s perfectly fine. It’s your money after all.

But at the same time, if you’re looking to amplify your stock gains by 2x… 10x… and even as much as 100x+… options are the way to get there when they’re available (not all marijuana stocks have options).

Step 3: Pick your exit point. I believe in planning for the worst and expecting the best. That’s why I never enter a trade without knowing exactly how much I can tolerate losing… and how much I’ll be happy with when things go as planned.

Again, the key here is to establish your plan before emotions like fear or greed cloud your vision… and affect your execution.
